3. Website Use
The HCL website is primarily intended to provide information and allow customers to request quotes.
Users may be asked to provide information including their name, address, phone number, email address, property photographs, and other information necessary to prepare an estimate or provide services.
Submitting a quote request does not create a binding obligation for HCL to perform services.
We reserve the right to decline any project at our discretion.
4. Quotes and Pricing
Unless otherwise stated in writing, quotes are valid for up to six months from the date issued.
Pricing is based on the information available at the time the quote is prepared, including photographs, measurements, customer-provided information, site conditions, product availability, and anticipated labor requirements.
HCL reserves the right to revise pricing if actual measurements, property conditions, access requirements, materials, labor requirements, or other circumstances materially differ from those originally represented.
Any additional work requested after approval may require a written or electronic change order and may result in additional charges.
5. Deposits and Payment
A 50% deposit is generally required before a customer is placed on the installation schedule.
The remaining 50% balance is due after installation unless otherwise stated in the applicable estimate, invoice, or agreement.
Deposits become non-refundable once custom materials have been ordered, prepared, cut, assembled, or otherwise committed to the project.
HCL may charge disclosed credit card processing fees.
Returned checks, failed payments, reversed payments, or improper chargebacks may result in additional fees.
Customers are responsible for reasonable collection costs and attorneys’ fees incurred by HCL in collecting valid unpaid balances, to the extent permitted by law.
6. Cancellations
Customers may cancel prior to materials being ordered or custom work beginning, subject to any applicable written agreement.
Once custom-cut, specialty, or project-specific materials have been ordered or prepared, deposits may become non-refundable.
Nothing in these Terms limits any cancellation or rescission right that cannot legally be waived under applicable law.
7. Scheduling
HCL generally schedules installations for specific dates to provide structure and planning.
However, all installation dates are subject to change due to:
-
Rain
-
Lightning
-
High winds
-
Wet or unsafe roof conditions
-
Severe weather
-
Extreme temperatures
-
Crew availability
-
Unexpected project delays
-
Material availability
-
Safety concerns
-
Other circumstances beyond HCL’s reasonable control
HCL may adjust a scheduled date or convert a scheduled appointment into a reasonable service window when necessary.
Schedule changes caused by safety or weather conditions do not constitute a breach of contract.
8. Property Access
Customers are responsible for providing reasonable access to all portions of the property necessary to perform the agreed work.
This includes access through:
-
Gates
-
Driveways
-
Yards
-
Electrical outlets
-
Trees
-
Rooflines
-
Common areas
-
Other service locations
If HCL cannot reasonably access the property at the scheduled time, we may reschedule the service.
A $70 trip charge may be added to the final invoice when our crew arrives but is unable to perform the work because required access was not provided.

9. Materials and Ownership
Unless otherwise stated in writing, customers own the lighting and décor purchased for their project after the initial installation.
Customer-owned materials may include:
-
Bulbs
-
Wire
-
Clips
-
Stakes
-
Extension cords
-
Timers
-
Plugs
-
Wreaths
-
Garland
-
Other décor
HCL does not generally rent these materials.
Custom-cut or specially prepared materials are non-returnable.
If a customer does not return for service in a subsequent year and does not request return of stored equipment within the applicable storage period, HCL may reuse, recycle, or dispose of certain materials as described in the Storage section below.
10. Installation Standards
HCL will make reasonable efforts to perform installations in a professional and workmanlike manner consistent with the approved design.
Installation methods may vary depending on:
-
Roofing material
-
Building surface
-
Landscape conditions
-
Electrical access
-
Trees and vegetation
-
Safety conditions
-
Manufacturer requirements
HCL retains discretion regarding the safest and most appropriate installation method.
11. Adhesives and Stucco
Certain installations may require or benefit from adhesive products.
HCL may decline to use adhesives on certain surfaces.
If a customer specifically requests adhesive or glue to be used on stucco or another surface, the customer acknowledges that adhesive residue, discoloration, or surface damage may occur.
HCL is not responsible for removal of adhesive residue or for repair or replacement of stucco or other surfaces when adhesive use was requested or approved by the customer.
12. Electrical Requirements
Customers are responsible for providing functioning electrical service and suitable outlets necessary to power the display.
GFCI-protected outlets are preferred where appropriate.
If an outlet is not functioning properly, HCL may attempt to identify another available outlet, but the customer remains responsible for hiring a qualified electrical professional to diagnose or repair electrical issues.
HCL may refuse or discontinue installation when electrical conditions appear unsafe.
Customers are responsible for all electricity usage and utility costs associated with the display.
13. Maintenance
HCL provides in-season maintenance for normal installation-related issues during the holiday season.
We generally attempt to respond to covered maintenance requests within approximately 48 hours.
The 48-hour response target is not guaranteed during major storms, widespread outages, severe weather events, natural disasters, or other conditions that produce unusually high service demand or create unsafe working conditions.
Covered maintenance may include normal issues involving:
-
Bulbs
-
Timers
-
Wire connections
-
Wreaths
-
Garland
-
Installation-related wiring
-
Similar workmanship-related issues
14. Maintenance Exclusions
Free maintenance does not generally cover damage or failures caused by circumstances outside HCL’s workmanship, including:
-
Storms
-
High winds
-
Lightning
-
Animals
-
Squirrels or other wildlife chewing wiring
-
Landscapers
-
Roofers
-
Contractors
-
Customer modifications
-
Vandalism
-
Theft
-
Power outages
-
Utility problems
-
Electrical outlet failures
-
GFCI issues
-
Falling limbs
-
Construction activity
-
Third-party interference
-
Other external causes
Replacement materials or significant repairs resulting from these circumstances may be billed separately.
For certain electrical or GFCI issues, HCL may first attempt to troubleshoot the problem remotely with the customer before scheduling an onsite service visit.
HCL may charge a service-call fee when the issue is determined to be unrelated to HCL workmanship.
15. Customer Modifications
Customers should not cut, move, alter, disconnect, repair, reconfigure, or otherwise modify installed lighting or décor without authorization from HCL.
HCL staff may guide a customer through simple troubleshooting over the phone.
Unauthorized modifications may void applicable maintenance coverage for the affected portion of the installation.
16. Property Conditions
Customers are responsible for informing HCL of known property conditions that may affect installation or safety, including:
-
Fragile roofing
-
Damaged shingles
-
Loose gutters
-
Weak structures
-
Stucco concerns
-
Irrigation systems
-
Hidden electrical wiring
-
Landscape hazards
-
Underground utilities
-
Structural defects
HCL is not responsible for damage caused primarily by pre-existing defects, deterioration, hidden conditions, or unsafe property conditions that were not caused by HCL.

17. Trees and Tree Lighting
Tree installations involve unique risks related to natural growth and movement.
Customers acknowledge that trees may be affected by:
-
Growth
-
Wind
-
Falling branches
-
Sap
-
Insects
-
Wildlife
-
Bark movement
-
Weather
HCL may refuse to climb, wrap, or decorate any tree that we believe presents an unreasonable safety risk.
Tree wraps are generally intended to be temporary seasonal installations.
Customers must disclose in advance if they intend for tree lighting to remain installed long-term.
Leaving tightly wrapped lighting on growing trees for extended periods may cause damage to the tree, wiring, or lighting system.
18. Removal
Seasonal removal is generally performed between January 2 and January 27.
Removal dates are provided as approximate windows and may change based on routing, weather, workload, safety conditions, and crew availability.
HCL does not guarantee an exact removal date.
Customers requesting delayed removal should understand that HCL does not guarantee removal after February.
If lighting remains installed beyond the normal removal season, the customer assumes responsibility for:
-
HOA violations
-
HOA fines
-
Weather exposure
-
UV damage
-
Product deterioration
-
Electrical deterioration
-
Increased replacement requirements
HCL is not responsible for fines or penalties imposed by an HOA, property manager, municipality, or other authority because decorations remained installed beyond permitted dates.
19. Storage
Storage is generally included for returning HCL customers unless otherwise stated.
HCL will exercise reasonable care when storing customer materials.
However, HCL is not responsible for ordinary deterioration or damage caused by circumstances beyond our reasonable control, including:
-
Normal wear
-
Age
-
Product deterioration
-
Manufacturer defects
-
Moisture
-
Pests
-
Extreme weather
-
Natural disasters
-
Storage-related material aging
If a customer does not renew service, HCL will generally store the customer’s materials for up to 365 days.
The customer is responsible for notifying HCL in writing if they wish to retrieve their materials.
After 365 days, HCL may, at its discretion and to the extent permitted by law, recycle, discard, or otherwise dispose of unclaimed materials.
Customers who are not returning for future service may be required to retrieve their materials from HCL’s storage location in Katy, Texas.
Delivery of stored materials to the customer’s property is at HCL’s discretion and may be subject to additional charges.
20. HOA Approvals and Property Restrictions
Customers are responsible for obtaining any required approval from:
-
HOAs
-
Property managers
-
Landlords
-
Municipal authorities
-
Other governing entities
The customer is responsible for informing HCL of all known property restrictions.
Unless specifically agreed otherwise in writing, the customer is responsible for obtaining any permit or authorization required for the requested work.
21. Design Approval and Changes
HCL may provide photographs, renderings, drawings, diagrams, descriptions, or other design materials showing the proposed installation.
Customer approval of a design authorizes HCL to install the project substantially according to that design.
Minor differences may occur because of actual field conditions.
If installation workmanship is materially inconsistent with the approved design, HCL will have a reasonable opportunity to correct the affected work.
A customer's change in preference after approval does not create an automatic right to a refund.
Requested changes after approval may be billed through a change order.
22. Refunds
Completed installations are generally non-refundable.
HCL will make reasonable efforts to correct legitimate workmanship issues.
Refunds will not normally be issued solely because a customer changes their mind about an approved design after installation has been completed substantially according to the approved plan.
23. Photography and Marketing
HCL may photograph or record completed installations and use those images or recordings for legitimate business and marketing purposes, including:
-
Website content
-
Social media
-

However, we do not guarantee that all website content will always be complete, current, error-free, or available.
Pricing, services, product availability, policies, and website content may change without notice.
26. Third-Party Links and Services
The website may include links to third-party websites or services.
HCL does not control and is not responsible for the content, availability, security, policies, or practices of third-party websites.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
To the fullest extent permitted by law, HCL’s aggregate liability arising out of a particular service project will not exceed the amount actually paid to HCL for the specific services giving rise to the claim.
28. Force Majeure
HCL will not be liable for delays or inability to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, government orders, supply shortages, labor disruptions, utility failures, accidents, unsafe conditions, or similar events.
29. Notice of Dispute and Opportunity to Cure
Before initiating formal legal proceedings, a customer must provide HCL with written notice describing the dispute and requested resolution.
Notice should be sent to:
support@htxchristmaslights.com
Houston Christmas Lights LLC will have 15 days after receiving the notice to attempt in good faith to resolve or cure the dispute.
The parties agree to make a reasonable good-faith effort to resolve disputes directly before proceeding to mediation or arbitration.
30. Mediation
If a dispute is not resolved during the 15-day cure period, the parties agree to attempt good-faith mediation before initiating binding arbitration, except where prohibited by law or where immediate relief is legally necessary.
The parties will reasonably cooperate in selecting a mediator.
31. Binding Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A JUDGE OR JURY.
Except for claims eligible for small-claims court or another expressly stated exception, disputes that cannot be resolved through the procedures above will be resolved through binding individual arbitration.
Arbitration will be conducted on an individual basis and not as a class, collective, consolidated, or representative proceeding.
The arbitration provision is intended to apply mutually to both HCL and the customer.
Arbitration will take place in the Houston, Texas area when legally permitted, unless the parties agree otherwise or applicable law requires another location.
32. Jury Trial Waiver
To the fullest extent permitted by law, HCL and the customer knowingly and voluntarily waive the right to a trial by jury for disputes subject to arbitration or for any dispute in which a jury-trial waiver is otherwise enforceable.
33. Class Action and Representative Action Waiver
To the fullest extent permitted by law, each party agrees that claims must be brought individually.
Neither party may bring or participate in a class, collective, consolidated, mass, or representative action against the other.
This waiver is intended to operate independently of the arbitration provision to the extent legally enforceable.
34. Small Claims and Collection Exception
Either party may pursue an eligible claim in small-claims court.
HCL may also pursue lawful collection remedies for unpaid invoices or other amounts due, subject to applicable law.
Use of a permitted small-claims or collection remedy does not necessarily waive other rights under these Terms.
35. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Where legally permitted, venue for court proceedings that are not subject to arbitration will be in Harris County, Texas, or another legally required venue.
36. Severability
If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
If part of the arbitration or class-action provisions is unenforceable, the remaining portions will continue to apply to the extent legally permitted.
37. Electronic Acceptance
Electronic approval of a quote, estimate, invoice, contract, checkbox, digital signature, payment authorization, or similar electronic action may constitute acceptance of these Terms when clearly presented to the customer.
38. Changes to These Terms
HCL may revise these Terms from time to time.
The version applicable to a particular project will generally be the version in effect when the customer accepts the applicable quote or agreement, unless otherwise required by law.
Updated website Terms will be effective when posted unless otherwise stated.
39. Entire Agreement
These Terms, together with the applicable estimate, proposal, invoice, design approval, change order, and any signed service agreement, constitute the agreement between the customer and HCL regarding the applicable services.
If a signed written agreement directly conflicts with these website Terms, the signed agreement will control for that specific project unless the agreement states otherwise.
